Fludroid systems, websites and applications use the information that is collected for the following general purposes: provision of products and services, billing, identification and authentication, service improvement, contact and research.

The term “personal information” used herein is defined as any information that identifies or can be used to identify, contact or locate the person to whom such information pertains. The personal information we collect will be subject to this Privacy Policy, which changes from time to time.

The security of your personal information is important to us. When you enter sensitive information, we encrypt the transmission of that information using Secure Socket Layer (SSL) technology. No method of transmission over the Internet or method of electronic storage is 100% secure. In the event of a security incident that results in the destruction, loss, alteration, unauthorized access or leakage of Personal Data, Fludroid will assess the risks and possible damages caused and shall communicate, within a reasonable time, the holder and the public authorities competent in this regard. We will adopt all available and reasonable measures to mitigate any damage caused to the holders of Personal Data that have been processed by Fludroid.

It is the sole and exclusive responsibility of Users or Partners, as the case may be, any security incident that occurs in their account or with their Personal Data, or with Personal Data of third parties that the User may impute or process on the Platform, due to acts or facts in which the User or the Partner competes with exclusive or concurrent guilt, such as acts of disclosure of their access information (login and password) to third parties, use of public access computers (e.g., lan house) or any other way of connecting to the internet that is not private and secure. In such cases, no liability can be attributed to Fludroid or its partners providing security, processing and data storage services.

We collect Personal Data and Non-Personal Data in the following ways: (a) through the platform itself, when the User or Partner browses the system, sends information and content or contacts us, through any service channel; (b) through the voluntary provision of data by Users or Partners, when the User or Partner informs their data for registration purposes, sends documents; and (c) through independent sources, when we carry out research with banking institutions, payment processors, companies or credit protection agencies, among others.

We may also record your IP, browser type, device and mobile operator, geographic position and other user-related data. However, in general, the information collected and existing in our systems is information that users are willing to provide through registration to use system resources, such as: issuing invoices or information obtained automatically with authorization. When you make payments through the platform, we, or partner companies that process payment on our behalf, may also collect payment information, which includes account information, credit or debit card number, etc.

Fludroid may use cookies and other monitoring or tracking technologies for the purpose of (a) providing and operating the Platform’s features and services; (b) improve the experience of Users and Partners on the Platform; (c) identify technical problems and failures; and (d) monitor and improve the overall performance of the Platform.

We use tracking services provided by Google, Facebook and other platforms. These services allow us to reach people who have already visited our site, and show them relevant advertisements when they visit other sites.

We do not sell or provide personal information to other companies in order for them to market their own products or services. However, we do advertise partner offers within Fludroid products. Thus, the platform may contain links to other websites and Fludroid cannot be held responsible for the privacy practices of those other websites. The User also freely and expressly consents that their information may be transferred to third parties as a result of the sale, acquisition, merger, corporate reorganization or any other change in Fludroid’s control.

Fludroid sends alerts, notifications and communications, and the user hereby authorizes, in order to allow the user to explore all its features, as well as with information relevant to accounting, financial planning or issues related to business management, among other types. We may also perform generic analyzes of users’ behavior that may be shared with third parties, but the user will never be individually identified.

Fludroid reserves the right to change this policy at any time, informing the user with a reasonable period of time for him to take notice and express new agreement.

It is the responsibility of the users:

• Use the website and its services in accordance with these Terms of Use, with the law, accepted morals and good customs and public order.
• Do not maliciously exploit the security of the system: The User undertakes to use the website and its services in an adequate and diligent manner, as well as to stop using it for purposes or means for the practice of illegal acts, prohibited by law and by these Terms of Use, harmful to the rights and interests of third parties, or that, in any way, may damage, disable, overload or deteriorate the website and its services, as well as the computer equipment of other Users or other Internet users (hardware and software) as well as documents, files and all kinds of content stored on your computer equipment or prevent the normal use or enjoyment of the website and its services, computer equipment and documents, files and content by other Users and others netizens.
• The User is responsible for any and all registration information entered into the systems, Fludroid is not responsible for any errors and losses resulting from erroneously registered information. It is up to the User to consult his accountant, or any other professional, before registering, mainly, the tax information required by the system.
• The User undertakes to use the system at his/her own risk, committing to carry out all tests in the Homologation environment before using it in the Production environment, to check if the system meets his/her needs and is free from errors.
• The User must complete the registration with accurate and true information, as well as update all the data made available on the website whenever there is any change.
• The User will keep the password confidential. The User will access his/her account through his/her e-mail address and password, being fully responsible for the use made of them. You also undertake to notify Fludroid immediately of any unauthorized use of your account, as well as unauthorized access by third parties to your account. Fludroid is not responsible for any loss or damage caused by the User’s fault.

In view of the technical and economic infeasibility of absolute prevention against attacks, invasions, graffiti or other illicit acts in the INTERNET environment, they exempt each other from any respective responsibilities. Therefore, Fludroid does not guarantee, in any way, the provision of the service in an uninterrupted and/or error-free manner.

To the fullest extent permitted by applicable law, the software is provided “as is” and “as available”, with all faults and without warranty of any kind. Therefore, Fludroid does not warrant that the functions contained in the software will meet all of your needs, that the operation of the software will be uninterrupted and/or error-free, that any service will continue to be available, that defects in the software will be corrected, or that the software will be compatible or work with any third party software, applications or services.

In no event shall Fludroid be liable for personal injury or any incidental, special, indirect or consequential damages, including, without limitation, damages for loss of profit, corruption or loss of data, failure to transmit or receive data, non-continuity of business or any other business loss or loss arising out of or related to your use of, or your inability to use, the software for any other reason.

The services and resources made available on the platform do not generate an acquired right on the part of the User, and Fludroid may interrupt, limit, charge or reduce the period of availability as well as the features offered free of charge.

Fludroid may suspend, interrupt or discontinue the Platform, at any time, at its discretion and as it sees fit, even if outside the cases provided for in these Terms of Use, upon reasonable notice to Users, without this configuring any type of responsibility.

Fludroid may also notify, suspend or block at any time, partially or totally, the access of any user who misuses the system or fails to comply with the rules defined in these terms. With or without notice. These users who misuse the system, and who for their actions, harm other users, may be civilly and criminally liable.

Fludroid reserves the right to modify the conditions presented in these Terms, at any time, by updating its website. If the modifications to be made in these Terms of Use are not approved by the User, he/she has the right to refuse the new conditions and terminate these Terms of Use immediately. The termination of this Term is made through notification by email, requesting the cancellation of the account through any service channel made available by Fludroid.
